What Makes a Nikah an Islamic Marriage?

At the centre of Nikah are clear consent, offer and acceptance, agreed mehr and the required witnesses or guardianship arrangements according to the applicable school of Islamic law. Details can differ between Sunni and Shia schools and between individual circumstances, so a responsible service should not present one cultural custom as the only valid Islamic form.

Consent Is Essential

Both parties must enter the marriage freely. A Nikah should not be arranged through coercion, deception or pressure. Identity, marital status and capacity should be checked before a ceremony is confirmed.

A written Nikah Nama is extremely important for evidence, registration and protection of the parties’ rights, but it should not be described as universally constituting the religious validity of every Nikah by itself. A religious Nikah may satisfy the couple’s faith requirements but not automatically create the legal status of marriage in England and Wales. UK civil marriage has its own statutory requirements. An overseas marriage may also raise a separate recognition question depending on the law under which it was contracted and the evidence available.
